Terms & Conditions – One-Time Launch Offer

Eligibility

This promotional offer is available to the first five customers who meet the eligibility criteria and sign a formal building contract with Kastell Building Co. Eligibility is determined based on the date and time a signed construction works contract is received. This offer is valid from 09/02/2025 to 01/06/2025. The promotion applies exclusively to a construction works contract and does not include design-only contracts. Customers who transition from a design contract to a construction contract during the promotional period will be eligible.

Offer activation & application
  • Signed Contract Requirement: The offer is available only once the signed construction works contract is received. The contract must be signed within 14 days from the date it is issued to be eligible for the discount.
  • Transition from Design to Construction: Customers who enter into a design contract during the promotional period and subsequently transition to a construction works contract will be eligible for the offer, provided the construction works contract is signed before 01/06/2025.
  • Quotes vs. Signed Contract: The discount applies only to the signed construction contract price. The promotion is not applicable to quotes, estimates, or informal proposals. Quotes and estimates are non-binding, and the offer will only be applicable to the price once the formal contract has been signed.
Project value

This offer is valid for cost-plus projects only with a total project value ranging from $50,000 to $200,000, excluding the builder’s margin. The total value is based on renovation-related costs, including labour, materials, and subcontractor fees, but excluding the builder’s margin. GST (Goods and Services Tax) is included in all costs.

For projects exceeding $200,000, the first $200,000 will qualify for the 5% builder’s margin (5.26% markup), while any amount above this threshold will be charged at the standard 25% builder’s margin (33.33% markup). Any changes to the original scope will also be charged at the standard margin.

Discount

The promotional offer provides a 5% builder’s margin (5.26% markup), applicable to the first $200,000 of the project. After this threshold, the standard 20% builder’s margin (25% markup) applies. Please note that this discount will only apply after the construction contract is signed. The discount is non-applicable to any quotes or estimates.

Example savings:
  • On a $50,000 Project:
    • At the standard 25% margin (33.33% markup), the margin would be $16.666.67.
    • With the 5% margin (5.26% markup), the margin is reduced to $2,631.58.
    • Total savings: $14,035.09
    • Total contract price: $52,631.58 (inclusive of GST).
  • On a $200,000 Project:
    • At the standard 25% margin (33.33% markup), the margin would be $66,666.67.
    • With the 5% margin (5.26% markup), the margin drops to $10,526.32.
    • Total savings: $56,140.35.
    • Total contract price: $210,526.32 (inclusive of GST).
  • On a $250,000 Project:
    • The first $200,000 qualifies for the 5% margin, saving $56,140.35.
    • The remaining $50,000 is charged at the 25% margin (33.33% mark-up), resulting in a margin of $16,666.67.
    • Total savings: $56,140.35.
    • Total contract price: $277,192.99 (inclusive of GST).
Offer validity

This promotional offer is available for a limited time and applies only to the first five eligible customers who sign a formal construction contract. Once the offer reaches the limit of five customers, it will no longer be available.

It is only valid for projects in the Greater Sydney area.

Exclusions
  • The offer is not valid for fixed-price contracts unless otherwise agreed in writing.
  • The discount is applicable only to the signed construction contract price and does not apply to quotes or estimates.
  • Any modifications to the project scope outside of the original design and signed contract will be subject to our standard standard 25% margin (33.33% markup). Clients will benefit most by avoiding changes after contract signing.
Payment terms

The payment terms are as follows:

  • 10% deposit upon signing the construction contract.
  • Weekly progress claims consisting of all project costs, including the agreed margin, minus a prorated amount of the deposit over the course of the contract period.
Refunds/return conditions
  • If the customer cancels the contract after the project has commenced, any discount applied to the project will be forfeited. Furthermore, the customer will be liable for any work completed up to the point of cancellation, and any materials or services already provided.
  • Example: If the work has begun and the customer cancels, they will be required to pay for the work completed up to that point, including the full amount of any previously applied discounts.
Force majeure/unforeseen circumstances

Neither party will be held liable for delays or failure to perform due to events beyond their control, including but not limited to natural disasters, government-imposed regulations, strikes, or any other unforeseen circumstances that prevent the completion of work. Any additional costs incurred as a result of these events, including adjustments to timelines and project scope, will be payable by the client and subject to the standard 20% margin (25% markup).

Consumer rights & local laws

Nothing in these Terms & Conditions shall affect the customer’s statutory rights under applicable consumer protection laws. The customer is entitled to all protections afforded under local consumer law, including rights to refunds, repairs, or replacements for defective work.

Limitation of liability

Kastell Building Co. will not be liable for any indirect, consequential, or punitive damages arising from the performance of the contract or use of the promotion. The customer's exclusive remedy for any defect, damage, or delay in the performance of the contract will be limited to the total amount paid for the project. In no event will Kastell Building Co. be liable for any damages beyond the agreed project costs.

Dispute resolution

Any disputes arising from this promotion or the contract will be handled in accordance with the HIA Building Contract dispute resolution procedures. Both parties agree to attempt to resolve any disputes through mediation before proceeding with any legal action.

Jurisdiction

These Terms & Conditions, and the resulting contract, are governed by the laws of the state of New South Wales, Australia. Any disputes will be resolved in the courts of the state of New South Wales, Australia.

Right to amend

Kastell Building Co. reserves the right to amend or revise these Terms & Conditions at any time, without prior notice, to reflect changes in business operations or external factors. Any changes will be communicated to participants.

Privacy and Data Use

By participating in this promotion, customers agree to provide necessary personal and contact information to Kastell Building Co. for the purpose of managing and administering this promotion. All data collected will be handled in accordance with Kastell Building Co.’s privacy policy, and will not be shared with third parties without the customer’s consent, unless required by law.
